In a word, “choice.” This program allows customers to choose their natural gas commodity supplier, pricing option, and term, giving each customer the opportunity to make the selection that works best for their budget.
The utility (Black Hills Energy) transports natural gas to your home or farm, sends your monthly bill and handles any service issues you may have. Your natural gas supplier is the company that provides your natural gas commodity. In Nebraska and Wyoming, you can select your supplier, pricing option and term. Regardless of which natural gas commodity supplier you select, your utility is still Black Hills Energy.
No. Your service will not be disrupted. The only difference that results from choosing a new natural gas commodity supplier may be the price you pay. Your supplier is listed under the Energy Supply portion of your bill.

You're selecting the price option for how your natural gas commodity is billed.
Supplier
You're selecting the supplier that will provide you with your natural gas commodity. Each participating supplier has undergone an application process, and has proven that they are able to meet all requirements set forth in Black Hills Nebraska Gas, LLC tariff, and Black Hills Wyoming Gas, LLC tariff, as approved by the Public Service Commissions in Nebraska and Wyoming.
Term
You're selecting how long you want to lock in the price you pay and the natural gas commodity supplier that will provide you with your natural gas commodity.
Account number - this is provided by the utility and can be found on your bill and on your selection form.
Confirmation code - a confirmation code is necessary in order to make a selection. Each price quote is paired with a confirmation code and provided to you by the supplier who gave you the quote. The confirmation code ensures that you receive the correct price. Prices can change and confirmation codes are often time-sensitive. Make sure to ask how long your code will be valid, if you don’t plan on signing up right away.
Control number - this number is provided to you directly by the utility and may be found on the selection form included in your packet. It allows you to securely make your selection online or with a natural gas commodity supplier.

You may select your natural gas commodity supplier by visiting the Black Hills Choice Gas website at choicegas.com, or by visiting the websites for each participating supplier.
Phone
Black Hills Energy’s IVR system can accommodate your choice gas selection. If you decide to use that service, you will need a confirmation code. To retrieve your confirmation code from Legacy Natural Gas via phone, please call 888-452-8231 to speak with a representative.
Mail
Black Hills Energy sends a packet to your address each year. Check the Legacy Natural Gas box on the selection form you received in the mail and choose the pricing option you want by writing the corresponding confirmation code next to that option. To get your confirmation code, click here or call our toll-free number, 888.452.8231, to talk with a knowledgeable representative. Once you have made your selection, simply return your ballot in the mail prior to the selection period deadline. Be sure to sign your ballot or it will not be valid.
Supplier
You can also make your selection through your chosen natural gas commodity supplier by providing them with your account number and control number. Do not provide your control number to a supplier until you are ready to choose that supplier. Upon doing so, you are authorizing that Supplier to make your Choice Gas selection on your behalf.
Natural gas can be a volatile commodity with prices going up or down substantially over time. Prices may vary depending on several factors, including weather, the supply and demand for natural gas, and lack of certainty in the market. The farther out our contract goes, the less certainty there is, and that is why you may see a higher price for a three-year term, than you would on a one-year term.
If you don’t submit a valid selection on or before the deadline, your account automatically rolls over to your current supplier and your pricing will be determined by your current supplier within 15 days of the end of the selection period. Default rates may be higher than a competitive rate that you receive during the selection period.
No. Changes in distribution rates can occur from time to time and are subject to the approval of the Public Service Commissions in Wyoming and Nebraska.
No, your bill will continue to come from Black Hills Energy.
If you move from one service address to another, or if you are a new customer who moves to a service address within the Choice Gas territory, you will continue with the supplier previously selected at that address. If you are a new construction customer, the utility will mail you a temporary enrollment packet.

2025 Program Year
This agreement ("Agreement") outlines the terms and conditions for receiving natural gas commodity service from Legacy Natural Gas ("Legacy"), a Competitive Natural Gas Commodity Supplier in the Nebraska Agricultural Choice Gas Program and its Customers (“You”).
Enrollment: By accepting Legacy’s natural gas commodity service verbally, in writing, electronically, or as a Default customer under the Utility's applicable tariff, you acknowledge that you have selected Legacy as your Natural Gas Commodity Supplier (“Supplier”). Legacy will supply the natural gas commodity for your natural gas account (“Account”) subject to the eligibility requirements of my local utility, Black Hills Nebraska Gas, LLC d/b/a Black Hills Energy, and acceptance by Legacy Natural Gas.
Legacy Natural Gas Services: This Agreement and any renewal notice from Legacy (if applicable) supersedes any oral or written statements made in connection with your natural gas commodity service. Black Hills Energy will maintain the natural gas system that delivers your natural gas, read meters, send bills, and answer questions.
Term and Renewal: Legacy will begin supplying your natural gas commodity effective as of the 1st day of April through the immediately succeeding March 31, and/or the start of the new program year. This Agreement will be valid for the chosen term of either twelve (12), Twenty-Four (24), or Thirty-Six (36) months. The Agreement will automatically renew for a twelve (12) month term (each “Renewal Term”) at the applicable natural gas commodity price option if you do not make a valid selection during the annual selection period. Legacy will set the default price for the applicable price option for each Renewal Term.
Market Index Price Plan: If you selected Legacy’s Market Index Price Plan, the monthly bill for your natural gas commodity usage will be calculated using the first of month index price for gas as purchased for your address, plus the adder agreed upon at the time of enrollment or assigned to your account upon default. To calculate the natural gas commodity charge, this price will be multiplied by the volume of gas used each month.
Fixed Price Plan: If you selected a Fixed Price Plan, your natural gas commodity bill’s usage will be calculated using the Fixed Price per therm you agreed to at the time of enrollment or assigned to your account upon default. To calculate your monthly natural gas commodity charge, this price per therm will be multiplied by the volume of gas used each month.
Events of Default: Legacy may terminate this Agreement if you fail to comply with the Utility’s payment terms.
Billing and Payment: The Utility, Black Hills Energy, will invoice you monthly for all charges applicable to your natural gas usage, including natural gas commodity costs, applicable taxes, and all applicable Utility customer charges and franchise fees. You will receive a bill from the Utility for Legacy natural gas commodity service each month of the term of this Agreement.
Confidentiality: Consistent with applicable regulatory requirements, Legacy will hold in confidence all information obtained from you and the Utility related to the provision of services under this Agreement, and which concern your energy characteristics and use patterns, except that Legacy may disclose such information to its affiliates and such affiliates’ employees, agents, advisors and independent contractors to be used for purposes of Choice Gas program business only .
Force Majeure: Legacy shall be excused for performance under this Agreement for events of Force Majeure declared by Legacy or the Utility. For purposes of this Agreement, The term “force majeure” shall mean any act of God, strike, walkout, or other industrial disturbance, act of the public enemy, war, riot, lightning, fire, storm, flood, earthquake, explosion, repair or maintenance, governmental regulation or restraint, inability to obtain any required governmental permits or authorizations, interruptions of FT or NNS services, or any other cause, whether of the kind specifically enumerated above or otherwise, which is not reasonably within the control of the claiming Party.
Change in Law or Market Structure: If a change in or implementation of law, rule, regulation, ordinance, statute, judicial decision, administrative order, Utility tariffs, pipeline tariffs or the like causes our costs under this Agreement to increase, we will have the right to pass such increased costs on to you without prior notice. The changes described in this section may change any or all the charges described in this Agreement.
Assignment: Legacy may assign this Agreement to another supplier authorized by the Utility provided that Legacy gives you written notice of such assignment, and the assignee assumes all of Legacy’s responsibilities and duties under this Agreement. You may not assign this Agreement without Legacy’s prior written consent, and any such transfer or assignment shall be void. Any required notice shall be deemed to have been made if mailed to your last known mailing address in Legacy’s records for the account. The laws of the state where the service is being provided shall govern the interpretation and performance of this Agreement. If the Nebraska Public Service Commission, or the Utility ends or changes the program under which you buy gas in a manner that physically prevents or legally prohibits Legacy from performing under the terms of this Agreement, Legacy may terminate this Agreement on fifteen (15) days’ notice.
Other Provisions: Legacy will retain title to its gas until the point of sale and delivery to Supplier’s customers at the delivery point located on or near customer’s premises, at which point title will then pass to you. Title and risk of loss transfer to you at your meter. Both you and Legacy agree irrevocably and unconditionally to waive any right to a trial by jury or to initiate or become a party to any class action claims in respect of any action, suit or proceeding directly or indirectly arising out of or relating to this Agreement.
Conflicts of Terms and Conditions: Any terms not defined herein will have the meanings set forth in the Black Hills Nebraska Gas, Tariff on file with the Nebraska Public Service Commission., and any conflicts between these terms and conditions and the State Natural Gas Regulation Act (“Act”), Company’s Tariff or Supplier Participation Agreement and related amendments or attachments will be resolved first in favor of the Act, the Company’s Tariff, and then the Supplier Participation Agreement and related amendments or attachments.

2025 Program Year
This agreement ("Agreement") outlines the terms and conditions for receiving natural gas commodity service from Legacy Natural Gas ("Legacy"), a Participating Natural Gas Commodity Supplier in the Choice Gas Program and its Customers (“You”). Customer acknowledges that this document is a binding and enforceable contract and that it will become effective when Customer enrolls in the Fixed Monthly Bill price option.
Enrollment: By accepting Legacy natural gas commodity service verbally, in writing, electronically, or as a Default customer under the Utility's applicable tariff, you acknowledge that you have selected Legacy as your Natural Gas Supplier (“Supplier”). Legacy will supply the natural gas commodity for your natural gas account (“Account”) service address subject to the eligibility requirements of my local utility, Black Hills Energy, and acceptance by Legacy Natural Gas.
Legacy Natural Gas Services: This Agreement and any renewal notice from Legacy (if applicable) supersedes any oral or written statements made in connection with your natural gas commodity service. Black Hills Energy will maintain the natural gas system that delivers your natural gas, read meters, send bills, and answer questions.
General Terms: monthly payment for all of Customer’s natural gas usage will be the amount agreed upon at the time of enrollment in the Fixed Monthly Bill price option. The amount Customer will be required to pay for natural gas for the Fixed Monthly Bill will not increase or decrease based on variations in weather conditions or changes in natural gas market prices. LEGACY NATURAL GAS reserves the right to alter Customer’s Fixed Monthly Bill amount if the utility or the pipeline upstream of the utility subsequently adds or changes any charges, or if any governmental authority adds or increases taxes or surcharges, or allows for the imposition of a tax, surcharge, fee or other charges. LEGACY NATURAL GAS also reserves the right to alter Customer’s Fixed Monthly Bill amount if any material change in Customer’s usage of natural gas, such as increased usage of more than 10% of the original gas usage when Customer enrolled in Fixed Monthly Bill, any additions or extensions, new equipment, leaks from Customer’s gas piping or appliances, discontinuing supplemental heat sources (such as wood stoves) and other additional heating demands. Customers agree to provide LEGACY NATURAL GAS with advance written notice of any such anticipated usage changes. LEGACY NATURAL GAS will provide written notice of the usage alteration to customer and the revised Fixed Monthly Bill amount will be provided through Customer’s bill. LEGACY NATURAL GAS will provide the reason for the change upon request to customer.

Inquiries Regarding Fixed Monthly Bill Service: Customer shall notify Legacy in case of errors or questions about your Fixed Monthly Bill service. If you think your Fixed Monthly Bill, or any adjustment thereto, is wrong, or if you need more information, you may contact LEGACY NATURAL GAS (888-452-8231) or 7812 E. 108th St. Suite C, Tulsa, OK 74133, enrollment@legacynaturalgas.com, as soon as possible. However, no action may be taken by Legacy until it receives written notice to the physical or email address listed above. Legacy must hear from you no later than 60 days after the first Fixed Monthly Bill, upon which an error or problem appeared. In your letter, please provide your full name and account number, the dollar value of the suspected error, and a description of the error. Legacy will acknowledge your letter within thirty (30) days of the inquiry.
Force Majeure: Legacy shall be excused for performance under this Agreement for events of Force Majeure declared by Legacy or the Utility. For purposes of this Agreement, The term “force majeure” shall mean any act of God, strike, walkout, or other industrial disturbance, act of the public enemy, war, riot, lightning, fire, storm, flood, earthquake, explosion, repair or maintenance, governmental regulation or restraint, inability to obtain any required governmental permits or authorizations, interruptions of FT or NNS services, or any other cause, whether of the kind specifically enumerated above or otherwise, which is not reasonably within the control of the claiming Party.
Change in law or market structure: If a change in or implementation of law, rule, regulation, ordinance, statute, judicial decision, administrative order, Utility tariffs, pipeline tariffs or the like causes our costs under this Agreement to increase, we and/or the Utility will have the right to pass such increased costs on to you without prior notice. The changes described in this Section may change any or all the charges described in this Agreement.
Assignment: Legacy may assign this Agreement to another supplier authorized by the Utility provided that Legacy gives you written notice of such assignment, and the assignee assumes all of Legacy’s responsibilities and duties under this Agreement. You may not assign this Agreement without Legacy’s prior written consent, and any such transfer or assignment shall be void. Any required notice shall be deemed to have been made if mailed to your last known mailing address in Legacy’s records for the account. The laws of the state where the service is being provided shall govern the interpretation and performance of this Agreement. If the Nebraska Public Service Commission, the Wyoming Public Service Commission, or the Utility ends or changes the program under which you buy gas in a manner that physically prevents or legally prohibits Legacy from performing under the terms of this Agreement, Legacy may terminate this Agreement on fifteen (15) days’ notice.
Other Provisions: Legacy will retain title to its gas until the point of sale and delivery to its customers at the delivery point located on or near customer’s premises, at which point title will then pass to you. Title and risk of loss transfer to you at your meter. Both you and Legacy agree irrevocably and unconditionally to waive any right to a trial by jury or to initiate or become a party to any class action claims in respect of any action, suit or proceeding directly or indirectly arising out of or relating to this Agreement.
Conflicts of Terms and Conditions: Any terms not defined herein will have the meanings set forth in the Black Hills Nebraska Gas, LLC Tariff on file with the Nebraska Public Service Commission or the Black Hills Wyoming Gas, LLC Tariff on file with the Wyoming Public Service Commission, and any conflicts between these terms and conditions and the State Natural Gas Regulation Act (“Act”), Company’s Tariff or Supplier Participation Agreement and related amendments or attachments will be resolved first in favor of the Act, the Company’s Tariff, and then the Supplier Participation Agreement and related amendments or attachments.

The utility (Black Hills Energy) transports natural gas to your home or farm, sends your monthly bill and handles any service issues you may have. Your natural gas supplier is the company that provides your natural gas commodity. In Nebraska and Wyoming, you can select your supplier, pricing option and term. Regardless of which natural gas commodity supplier you select, your utility is still Black Hills Energy.
No. Your service will not be disrupted. The only difference that results from choosing a new natural gas commodity supplier may be the price you pay. Your supplier is listed under the Energy Supply portion of your bill.

Supplier
You're selecting the supplier that will provide you with your natural gas commodity. Each participating supplier has undergone an application process, and has proven that they are able to meet all requirements set forth in Black Hills Nebraska Gas, LLC tariff, and Black Hills Wyoming Gas, LLC tariff, as approved by the Public Service Commissions in Nebraska and Wyoming.
Term
You're selecting how long you want to lock in the price you pay and the natural gas commodity supplier that will provide you with your natural gas commodity.
Account number - this is provided by the utility and can be found on your bill and on your selection form.
Confirmation code - a confirmation code is necessary in order to make a selection. Each price quote is paired with a confirmation code and provided to you by the supplier who gave you the quote. The confirmation code ensures that you receive the correct price. Prices can change and confirmation codes are often time-sensitive. Make sure to ask how long your code will be valid, if you don’t plan on signing up right away.
Control number - this number is provided to you directly by the utility and may be found on the selection form included in your packet. It allows you to securely make your selection online or with a natural gas commodity supplier.

You may select your natural gas commodity supplier by visiting the Black Hills Choice Gas website at choicegas.com, or by visiting the websites for each participating supplier.
Phone
Black Hills Energy’s IVR system can accommodate your choice gas selection. If you decide to use that service, you will need a confirmation code. To retrieve your confirmation code from Legacy Natural Gas via phone, please call 888-452-8231 to speak with a representative.
Mail
Black Hills Energy sends a packet to your address each year. Check the Legacy Natural Gas box on the selection form you received in the mail and choose the pricing option you want by writing the corresponding confirmation code next to that option. To get your confirmation code, click here or call our toll-free number, 888.452.8231, to talk with a knowledgeable representative. Once you have made your selection, simply return your ballot in the mail prior to the selection period deadline. Be sure to sign your ballot or it will not be valid.
Supplier
You can also make your selection through your chosen natural gas commodity supplier by providing them with your account number and control number. Do not provide your control number to a supplier until you are ready to choose that supplier. Upon doing so, you are authorizing that Supplier to make your Choice Gas selection on your behalf.
Natural gas can be a volatile commodity with prices going up or down substantially over time. Prices may vary depending on several factors, including weather, the supply and demand for natural gas, and lack of certainty in the market. The farther out our contract goes, the less certainty there is, and that is why you may see a higher price for a three-year term, than you would on a one-year term.
If you don’t submit a valid selection on or before the deadline, your account automatically rolls over to your current supplier and your pricing will be determined by your current supplier within 15 days of the end of the selection period. Default rates may be higher than a competitive rate that you receive during the selection period.
No. Changes in distribution rates can occur from time to time and are subject to the approval of the Public Service Commissions in Wyoming and Nebraska.
No, your bill will continue to come from Black Hills Energy.
If you move from one service address to another, or if you are a new customer who moves to a service address within the Choice Gas territory, you will continue with the supplier previously selected at that address. If you are a new construction customer, the utility will mail you a temporary enrollment packet.
